The office is responsible for the administration, monitoring and enforcement of the City’s minority and female-owned business enterprise programs; the new programs for smaller, local businesses; Fannie M. Lewis Cleveland Resident Employment Law programs; and prevailing wage compliance. 

  • MBE/FBE/Small Business Open Houses

    On the first Tuesday of every month from 10:00am to 12:00pm the City of Cleveland’s Division of Purchasing and Supplies hosts a virtual open house for minority-owned, female-owned and Cleveland small businesses. The purpose of these open houses is to educate attendees on how to compete for City business. Vendors may attend the meeting virtual (Via WebEx) or by coming to Cleveland City Hall, Room 128. Contact the Division of Purchasing and Supplies to request how you wish to attend the meeting. Space is limited for in office attendance and will be on a first come first serve basis.

  • Contractor's Submission Schedule

    Certified Payroll Reports, Workforce Tables, and Invoicing Affidavits are due on the 3rd Monday of every month by the end of business. Submissions should contain information for all work performed as of the last day of the prior month.

Electronic Submittal of Certified Payroll
Contractors are required to submit Certified Payrolls on a weekly basis online through LCPtracker. When a contractor is awarded a City project, the City will set up the project in the LCPtracker system, and provide the prime contractor with a log-in and password. In addition, subcontractors will be assigned log-ins and passwords.

This paperless submittal is not optional. Paper payrolls submitted to OEO will be returned, and the contractors will have to enter them into the online system to ensure payment of submitted invoices.

LCPtracker System
The LCPtracker system is a paperless, online system for entering certified payrolls. Rather than submitting paper Prevailing Wage forms (Affidavits of Prime Contractor, Statements of Compliance, Weekly Certified Payroll Spreadsheets, etc.), contractors will enter all payrolls and related information online. All project-specific wage rates & classifications will be online, and the contractor will choose specific rates and jobs from a menu.

Computer and Internet Access
The contractor will need a computer and internet access for LCPtracker. For contractors without this ability, the prime contractor of each project will provide the computer and equipment necessary to submit payrolls electronically. Public computers are available at most public libraries. In addition, the Mayor’s Office of Equal Opportunity has a dedicated computer with internet access for contractors to use.

Training Opportunities
Those interested in taking a LCPtracker class, are asked to contact the Mayor’s Office of Equal Opportunity at 216.664.4155 or via email. Free parking for class attendees is available to those parking in the building’s attached garage who bring a parking stub to class. In addition, training can be found online via tutorials made available when logging into the system.

Good Faith Effort Definition

The OEO monitors and enforces compliance with the City’s CSB participation goals by, among other means, evaluating each bidder’s OEO Schedules 1 through 4 to determine whether it has made a good-faith effort to employ CSB, MBE, and FBE subcontractors, as applicable to the contract. To make its determination, the OEO examines primarily the following aspects of the project and any particular bid:

  • Opportunities for Subcontracting. What opportunities the project presents for subcontracting part of the work is determined from the nature of project and scope of services and what other bidders propose to subcontract.
  • Availability of CSB/MBE/FBE Potential Subcontractors. The OEO then takes into consideration what number of CSB/MBE/FBE firms in the Cleveland Contracting Market, as applicable, are listed in its CSB/MBE/FBE Registry (available on the City’s website) for each potential area of subcontracting.
  • Bidder’s Commitment to CSB/MBE/FBE Subcontractors. The OEO refers to a bidder’s OEO Schedules 2 and 3 to see whether they are properly completed and consistent, and whether the quantity of project work the bidder represents it will subcontract to certified CSB/MBE/FBEs (measured as a percent of the total bid amount) meets the percentage goal(s) for the contract.
  • Bidder’s Efforts to Subcontract to CSB/MBE/FBE Firms. If a bidder does not demonstrate in its OEO Schedules that it will subcontract to certified CSB/MBE/FBEs a percent of work approximately meeting the contract goal(s), the OEO refers to a bidder’s Schedule 4. In the Schedule a bidder must document a sufficient number of contacts of available certified firms to meet the contract goal(s) or explain the unavailability of firms or the impracticality of subcontracting, as applicable. In evaluating Schedule 4, the OEO considers the subcontracting opportunities and number of certified firms available for each opportunity.

In December of 2012, the City of Cleveland’s Mayor’s Office of Equal Opportunity released results from an updated Disparity Study. The purpose of the Disparity Study is to ensure compliance with constitutional mandates and to learn more regarding minority and women business (M/WBEs) enterprise best practices. Specifically, the Study examines the geographic and product markets based on the City of Cleveland’s contracting and procurement.
