Notice of Intent to Request Release of Funds for Tiered Projects and Programs

On or after June 2, 2022, the City of Cleveland, Department of Community Development will submit a request to the Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) and HOME Investment Partnership Program (HOME) funds under Section 212(a)(1) of Title II (42 U.S.C. 12701 et seq.) of the Cranston-Gonzalez National Affordable Housing Act (as amended), to undertake the following Programs:

CDC Single Family Rehabilitation

The entire city of Cleveland is the applicable service area, which, according to 2010 U.S. Census Bureau, is approximately 77 square miles. Project timeframe is July 1, 2022 to June 30, 2023. Project sites will be existing residential structures in an urban setting. Rehabilitation activities may include, but are not limited to; re-seeding areas of bare soil; tree and shrub trimming or removal; replacing concrete or asphalt walkways and driveways; partial or full replacement or installation of siding; partial or full replacement of porch, roof, plumbing or electrical systems; partial or full replacement of porch, roof, plumbing or electrical system components; partial or full replacement or installation of windows or storm windows; relocation of electrical panel; partial or full replacement or installation of exterior doors or storm doors; partial or full replacement of interior doors; partial or full replacement of drywall or paneling; partial or full replacement or installation of acoustical or drop ceiling panels; partial or full replacement of flooring materials; partial or full replacement of stair systems; partial or full replacement of plumbing fixtures; substantial rehabilitation of kitchen or bathroom system; replacement of heat distribution system; replacement or installation of central air conditioning system; installation of enclosure systems; installation of encapsulation systems; paint stabilization; tuckpointing; installation of carbon monoxide detectors and smoke detectors; finish carpentry; pest management; site cleaning; partial or full replacement of gutters and/or downspouts; radon testing and necessary radon mitigation; waterproofing/sealing; specialized mold cleaning and/or paint/sealant application; installation of energy efficient fixtures and/or appliances; installation of appliances; installation of hot water tank; installation of fixtures, including health and safety measures and ADA adaptive measures, including necessary conversion. Tier 2 site-specific reviews will be completed for those laws and authorities not addressed in the Tier 1 broad review for each address under this program when addresses become known. The site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: Flood Insurance, Contamination and Toxic Substances, Floodplain Management, Historic Preservation and Noise Abatement and Control. Level of environmental review will be to 24 CFR Part 58.35(a)(3)(i). For each of the laws and authorities listed in the Tier 2 site-specific review, a written strategy has been developed, that outlines how the law or authority will be investigated, how a determination will be made, and if necessary, how mitigation will be handled. Total project cost is approximately $3,539,638. Of this, approximately $2,544,059 will be CDBG funding.

Furnace Replacement Program

The entire city of Cleveland is the applicable service area, which, according to 2010 U.S. Census Bureau, is approximately 77 square miles. Project timeframe is July 1, 2022 to June 30, 2023. Project sites will be existing residential structures in an urban setting. Rehabilitation activities include, but are not limited to: replacement of main gas, electric or hot water boiler system; and may include necessary repair of plumbing lines, radiators, vents, plumbing fixtures, minor paint stabilization, finish carpentry, site cleaning, necessary fixtures and electrical connections. Tier 2 site-specific reviews will be completed for those laws and authorities not addressed in the Tier 1 broad review for each address under this program when addresses become known. The site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: Flood Insurance, Contamination and Toxic Substances, Floodplain Management, Historic Preservation and Noise Abatement and Control. Level of environmental review will be to 24 CFR Part 58.35(a)(3)(i). For each of the laws and authorities listed in the Tier 2 site-specific review, a written strategy has been developed that outlines how the law or authority will be investigated, how a determination will be made, and if necessary, how mitigation will be handled. Total project cost is approximately $317,727. Of this, approximately $317,727 will be
CDBG funding.

Repair-A-Home Program

The entire city of Cleveland is the applicable service area, which, according to 2010 U.S. Census Bureau, is approximately 77 square miles. Project timeframe is July 1, 2022 to June 30, 2023. Project sites will be existing residential structures in an urban setting. Rehabilitation activities may include, but are not limited to, re-seeding areas of bare soil; tree and shrub trimming or removal; replacing concrete or asphalt walkways and driveways; partial or full replacement or installation of siding; partial or full replacement of porch, roof, plumbing or electrical systems; partial or full replacement of porch, roof, plumbing or electrical system components; partial or full replacement or installation of windows or storm windows; relocation of electrical panel; partial or full replacement or installation of exterior doors or storm doors; partial or full replacement of interior doors; partial or full replacement of drywall or paneling; partial or full replacement or installation of acoustical or drop ceiling panels; partial or full replacement of flooring materials; partial or full replacement of stair systems; partial or full replacement of plumbing fixtures; substantial rehabilitation of kitchen or bathroom system; replacement of heat distribution system; replacement or installation of central air conditioning system; installation of enclosure systems; installation of encapsulation systems; paint stabilization; tuckpointing; installation of carbon monoxide detectors and smoke detectors; finish carpentry; pest management; site cleaning; partial or full replacement of gutters and/or downspouts; radon testing and necessary radon mitigation; waterproofing/sealing; specialized mold cleaning and/or paint/sealant application; installation of energy efficient fixtures and/or appliances; installation of appliances; installation of hot water tank; installation of fixtures, including health and safety measures and ADA adaptive measures, including necessary conversion. Tier 2 site-specific reviews will be completed for those laws and authorities not addressed in the Tier 1 broad review for each address under this program when addresses become known. The site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: Flood Insurance, Contamination and Toxic Substances, Floodplain Management, Historic Preservation and Noise Abatement and Control. Level of environmental review will be to 24 CFR Part 58.35(a)(3)(i). For each of the laws and authorities listed in the Tier 2 site-specific review, a written strategy has been developed, that outlines how the law or authority will be investigated, how a determination will be made, and if necessary, how mitigation will be handled. Total project cost is approximately $13,696,484. Of this, approximately $3,121,799 will be CDBG funding, approximately $2,574,685 will be HOME funding and approximately $8,000,000 will be other CDBG funding.

Senior Homeowner Assistance Program

The entire city of Cleveland is the applicable service area, which, according to 2010 U.S. Census Bureau, is approximately 77 square miles. Project timeframe is July 1, 2022 to June 30, 2023. Project sites will be existing residential structures in an urban setting. Work to be performed will ensure the work area is brought to current code, and may include, but is not limited to, reseeding areas of bare soil; tree and shrub trimming or removal; replacing concrete or asphalt walkways and driveways; partial or full replacement or installation of siding; partial or full replacement of porch, roof, plumbing or electrical systems; partial or full replacement of porch, roof, plumbing or electrical system components; partial or full replacement or installation of windows or storm windows; relocation of electrical panel; partial or full replacement or installation of exterior doors or storm doors; partial or full replacement of interior doors; partial or full replacement of drywall or paneling; partial or full replacement or installation of acoustical or drop ceiling panels; partial or full replacement of flooring materials; partial or full replacement of stair systems; partial or full replacement of plumbing fixtures; substantial rehabilitation of kitchen or bathroom system; replacement of heat distribution system; replacement or installation of central air conditioning system; installation of enclosure systems; installation of encapsulation systems; paint stabilization; tuckpointing; installation of carbon monoxide detectors and smoke detectors; finish carpentry; pest management; site cleaning; partial or full replacement of gutters and/or downspouts; radon testing and necessary radon mitigation; waterproofing/sealing; specialized mold cleaning and/or paint/sealant application; installation of energy efficient fixtures and/or appliances; installation of appliances; installation of hot water tank; installation of fixtures, including health and safety measures and ADA-adaptive measures, including necessary conversion. Tier 2 site-specific reviews will be completed for those laws and authorities not addressed in the Tier 1 broad review for each address under this program when addresses become known. The site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: Flood Insurance, Contamination and Toxic Substances, Floodplain Management, Historic Preservation and Noise Abatement and Control. Level of environmental review will be to 24 CFR Part 58.35(a)(3)(i). For each of the laws and authorities listed in the Tier 2 site-specific review, a written strategy has been developed, that outlines how the law or authority will be investigated, how a determination will be made, and if necessary, how mitigation will be handled. Total project cost is approximately $9,601,093. Of this, approximately $1,601,093 will be CDBG funding and approximately $8,000,000 will be other CDBG funding.

Storefront Renovation Program

The entire city of Cleveland is the applicable service area, which, according to 2010 U.S. Census Bureau, is approximately 77 square miles. Project timeframe is July 1, 2022 to June 30, 2023. Project sites will be existing commercial structures in an urban setting. The Storefront Renovation provide comprehensive exterior rehabilitations for commercial or mixed-use properties. Rehabilitation activities include, but are not limited to new or replacement signage, door replacement, new or replacement exterior security systems, replacement windows, new or replacement awnings, new or replacement storefront display window systems, masonry repairs, landscaping repairs or replacements, fence installation, tuckpointing, finish carpentry, painting, exterior cleaning, replacement of light fixtures, repairs or installation of electrical system, engineering costs and architectural costs. Tier 2 site-specific reviews will be completed for those laws and authorities not addressed in the Tier 1 broad review for each address under this program when addresses become known. The site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: Flood Insurance, Contamination and Toxic Substances, Floodplain Management and Historic Preservation. Level of environmental review will be to 24 CFR Part 58.35(a)(3)(iii). For each of the laws and authorities listed in the Tier 2 site-specific review, a written strategy has been developed, that outlines how the law or authority will be investigated, how a determination will be made, and if necessary, how mitigation will be handled. Total project cost is approximately $567,000. Of this, approximately $567,000 will be CDBG funding.

All activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR Part 58.35(a)(3)(i) and 24 CFR Part 58.35(a)(3)(iii). PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the City of Cleveland. All comments received by June 2, 2022 will be considered by the City of Cleveland prior to authorizing submission of the request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The City of Cleveland certifies to HUD that Martin Bielat, in his capacity as Compliance Manager, Department of Community Development, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Cleveland to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and the City of Cleveland’s certification for a period of 15 days following the anticipated submittal date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Cleveland; (b) the City of Cleveland has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.

Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Department of Housing and Urban Development, Columbus Field Office at: CPD_COVID-19OEE-COL@hud. Potential objectors should contact Department of Housing and Urban Development, Columbus Field Office via email to verify the actual last day of the objection period.
